Welcome to Encore Income (“Encore”, “we”, “our”, or “us”). By registering with Encore and using our services, you (“the Artist”, “the User”, “you”) agree to the following Terms & Conditions. Please read these terms carefully before using the Encore platform.

1. About Encore

Encore is a promotional and distribution platform designed to help singers, musicians, tribute acts, entertainers and performers promote and sell music downloads, merchandise and related products through QR technology, promotional cards and artist pages.

Encore acts solely as a technology, promotion, fulfilment and payment processing service. Encore is not a record label, music publisher or rights management company.

2. Acceptance of Terms

By signing up to Encore and using the platform, you confirm that you:

  • Have read and understood these Terms & Conditions
  • Agree to comply with these Terms & Conditions
  • Are legally entitled to upload and distribute the content you provide

Use of the Encore platform constitutes acceptance of these terms.

3. Copyright & Content Ownership

The Artist confirms and warrants that all content uploaded to Encore, including but not limited to music tracks, recordings, backing tracks, artwork, images, logos, merchandise designs, videos and promotional materials is either:

  • Owned by the Artist, or
  • Properly licensed for commercial use and digital distribution by the Artist

The Artist accepts full legal responsibility for ensuring that all uploaded materials comply with copyright, licensing and intellectual property laws. Encore accepts no responsibility or liability for copyright infringement arising from materials supplied by Artists.

4. Artist Declaration

Before uploading content, Artists are required to confirm that they own the content, or have legal permission to use and distribute the content commercially. Submitting content without the necessary rights is strictly prohibited.

5. Removal of Content

Encore reserves the right to refuse content, suspend accounts, remove tracks, merchandise or artist pages, investigate complaints, and comply with copyright or legal requests without prior notice where necessary.

6. Payments & Revenue Distribution

Encore may collect payments on behalf of Artists for music downloads, merchandise, promotional items and related digital or physical products.

Payments due to Artists will be distributed according to the agreed payment structure and payout schedule. Encore reserves the right to deduct platform fees, processing fees, refunds, chargebacks, fulfilment costs and agreed commissions before payments are distributed.

7. Merchandise Fulfilment

Encore may arrange the printing, production and fulfilment of merchandise and promotional materials through third-party suppliers.

While Encore will make every reasonable effort to ensure quality and delivery, Encore cannot guarantee supplier availability, delivery times, courier performance or product availability. Artists acknowledge that third-party fulfilment services may occasionally experience delays or issues outside Encore's control.

8. Artist Responsibilities

Artists agree:

  • Not to upload unlawful or offensive material
  • Not to upload content that infringes copyright
  • Not to misuse the Encore platform
  • Not to impersonate other performers or organisations
  • To provide accurate account information

Artists are solely responsible for the accuracy and legality of all uploaded materials.

9. Limitation of Liability

Encore shall not be liable for loss of profits, business interruption, copyright disputes, third-party claims, data loss, delayed payments, technical interruptions, supplier delays or website downtime. Encore provides its services on a reasonable best-efforts basis.

10. Platform Availability

Encore aims to maintain reliable service but does not guarantee uninterrupted availability of artist pages, downloads, QR systems, payment systems or merchandise services. Services may occasionally be unavailable due to maintenance, technical issues or circumstances beyond our control.

11. Refunds

Due to the nature of digital products, music downloads are generally non-refundable once delivered. Physical merchandise refunds will be handled in accordance with applicable consumer protection laws and supplier policies.

12. Privacy

Encore will only use personal information for account administration, payment processing, customer support, service delivery and marketing communication where consent has been given. Encore will not knowingly sell personal information to third parties.

13. Termination

Encore reserves the right to suspend or terminate accounts where terms are breached, fraud is suspected, copyright complaints are received or abuse of the platform occurs. Artists may also request account closure at any time.

14. Changes to Terms

Encore reserves the right to update or modify these Terms & Conditions at any time. Continued use of the platform following updates constitutes acceptance of revised terms.
